TERMS OF SERVICE / PUBLIC OFFER
1. General Information
These Terms of Service (“Terms”) constitute a public offer and govern the provision of photographic services by Evija Pavlova, a self-employed photographer based in the United Kingdom (“the Photographer”).
By booking services, making a payment, or otherwise engaging the Photographer, the client (“the Client”) confirms acceptance of these Terms.
2. Services
The Photographer provides professional photography services, consultations, and digital products, including but not limited to PDF materials, online galleries, and digital image files (“Services”).
Services may include wedding, family, or portrait photography. The scope, date, duration, and specific details of the Services are agreed individually with the Client.
3. Booking and Payment
- A booking is confirmed only after receipt of a partial prepayment (“Booking Fee”).
- The Booking Fee secures the agreed date and time.
- The size of the Booking Fee depends on the type of session and, in the case of weddings, the selected package.
- Wedding sessions: Booking Fee is non-refundable in case of Client cancellation.
- Family and portrait sessions: Booking Fee is taken as a deposit; the Client may reschedule or, in some cases, agree on a refund (see section 4).
- Payments may be made in GBP or EUR.
4. Cancellations and Rescheduling
Client Cancellation:
- Wedding sessions: Booking Fee is non-refundable.
- Family and portrait sessions: Booking Fee may be refunded only if explicitly agreed in writing.
Rescheduling:
- Clients may reschedule up to two times per booking.
- Rescheduling must be notified at least 48 hours before the scheduled session.
- Rescheduled sessions should take place within one month of the original date unless otherwise agreed.
Photographer Cancellation:
- If the Photographer is unable to provide Services due to illness or force majeure, the Client may choose either:
- To reschedule the session, or
- To receive a full refund of all payments made.
5. Force Majeure
Neither party shall be held liable for failure or delay in performance caused by events beyond reasonable control, including but not limited to illness, severe weather, governmental restrictions, or third-party actions.
6. Image Delivery
- Final edited high-resolution images are delivered via a private online gallery.
- Standard delivery time is up to four (4) weeks, unless otherwise agreed.
- The Client is responsible for downloading and securely storing the delivered files.
- The Photographer does not guarantee storage of images beyond twelve (12) months from delivery.
7. Copyright and Usage Rights
- Copyright in all photographs and digital materials remains with the Photographer.
- The Client is granted a non-exclusive, perpetual license to use the images for personal purposes.
- Commercial use, sale, publication, or transfer to third parties requires prior written consent from the Photographer.
8. Portfolio and Promotional Use
- Unless otherwise agreed in writing, the Client grants the Photographer the right to use selected images for portfolio, website, social media, editorial, and promotional purposes.
- If the Client wishes to restrict such use, this must be communicated in writing prior to the session.
9. Limitation of Liability
- The Photographer’s total liability arising from or in connection with the Services shall be strictly limited to the amount actually paid by the Client.
- The Photographer shall not be liable for indirect, incidental, or consequential losses, including loss of profit, reputation, or emotional distress.
- Reasonable care is taken to safeguard digital files; however, in the unlikely event of loss or damage beyond the Photographer’s control, liability is limited as stated above.
10. Governing Law
These Terms shall be governed by and construed in accordance with the laws of England and Wales.
